During the Exhibition Brauerie C. & A. Veltins GMBH & Co. obtained samples of the PolarBag^TM product, and requested more samples. International Haotian Technology Co. Ltd. made the samples twice and sent them to the customer in Germany.

 

Brauerie C. & A. Veltins GMBH & Co. was aware from brochures and information, obtained at the Exhibition and from the manufacturer, that International Haotian Technology Co. Ltd. owned the Patent under which the product was manufactured.

 

However, Brauerie C. & A. Veltins GMBH & Co. sent the samples to Xiamen company, Xiamen Hoarfox Tour Articles Foiuse Co. Ltd., placed an order with this company for supply of the products, and contracted with Xiamen ZhongLuda Import & Export Co. Ltd. to export them.

 

By 10 March 2005, Xiamen Hoarfox Tour Articles Foiuse Co. Ltd. had manufactured 4,500 products infringing Patent ZL03 2 53795.6, the intellectual property of International Haotian Technology Co. Ltd., valued at about RMB100,000. By 16 March 2005, these products under the name of ¡°Cooler Bag for Beach¡± were loaded into container HJCU 1264166, ready for shipment from the Port of Xiamen to Germany.

 

On 8 March 2005, International Haotian Technology Co. Ltd. instructed Xiamen Lawyer Yang Yi of Xiamen Quisheng Law Firm to apply to the Xiamen Intellectual Property Office and the Regulation Department of the Xiamen Bureau of Customs to prevent the shipment on the grounds that Patent ZL03 2 53795.6 had been deliberately and illegally infringed by Brauerie C. & A. Veltins GMBH & Co. and Xiamen Hoarfox Tour Articles Foiuse Co. Ltd.

 

Brauerie C. & A. Veltins GMBH & Co made an out of Court settlement for loss and compensation to International Haotian Technology Co. Ltd by way of cash payment for the illegal infringement of the Patent.
